By accessing, purchasing, or using any course or services offered by Backpine LLC, you ("you," "your," "User," or "Student") agree to be bound by the following Terms and Conditions. These Terms constitute a legally binding agreement between you and Backpine LLC. If you do not agree with these Terms, you may not use or access our services.

1. Ownership and Intellectual Property

All course materials, including but not limited to video lectures, written content, downloadable materials, designs, logos, trademarks, and other intellectual property (collectively, "Course Content"), are the sole property of Backpine LLC or its licensors. Course Content is provided for your personal, non-commercial use only.

You agree not to reproduce, redistribute, sell, license, sublicense, rent, modify, or create derivative works from any Course Content without express written permission from Backpine LLC.

2. Prohibited Conduct

You agree not to:

• Share your account or login credentials with others;
• Attempt to gain unauthorized access to any part of the platform;
• Engage in any activity that interferes with or disrupts the platform;
• Copy, record, or disseminate course content by any means;
• Use the platform in violation of any applicable law or regulation.

Violation of this section may result in immediate termination of access without notice and may subject you to legal liability.

3. Use of Third-Party Services

In delivering our courses, Backpine LLC may utilize third-party platforms and cloud service providers—including but not limited to video streaming services, hosting infrastructure, content delivery networks, and other technology partners—that may operate on a usage-based billing model.

You acknowledge and agree that:

• Certain third-party services used in connection with our courses may impose costs based on your individual usage, such as data transfer, bandwidth consumption, or subscription activity;
• Backpine LLC does not control, monitor, or limit how third-party platforms measure or bill usage, and cannot prevent or reverse any charges incurred as a result of your interactions with such services;
• You are solely responsible for monitoring your own internet/data usage and any associated charges imposed by your internet service provider, mobile carrier, or any other platform you use to access the course content.

Under no circumstances shall Backpine LLC be held liable for any actual or perceived charges, fees, or unexpected bills incurred by you as a result of using or accessing our courses through third-party platforms or services.

By using our platform, you expressly release Backpine LLC from any and all claims related to third-party billing, including overages, platform access costs, and any incidental or consequential charges.

4. Limitation of Liability

To the fullest extent permitted by law, Backpine LLC disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.

In no event shall Backpine LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the platform or course content;
• Any conduct or content of any third party;
• Any unauthorized access, use, or alteration of your transmissions or content.

5. Payment Terms and Refund Policy

All course purchases are final. Backpine LLC does not offer refunds, exchanges, or credits for any reason, including but not limited to dissatisfaction with the course, non-usage, or changes to the user's personal or professional circumstances.

By completing a purchase, you acknowledge and accept that no refund will be provided under any circumstances.

6. Modifications to Terms and Platform

Backpine LLC reserves the right to update, modify, or amend these Terms at any time. We also reserve the right to modify, suspend, or discontinue any aspect of the platform, including course offerings and availability, without notice or liability.

It is your responsibility to review these Terms periodically. Your continued use of the platform constitutes acceptance of any modifications.

7. Governing Law and Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in King County, Washington, and you hereby consent to personal jurisdiction and venue therein.

8. Course Access and Duration

Backpine LLC endeavors to provide enrolled students with access to purchased course content indefinitely ("lifetime access"), subject to technical availability and platform viability. However, Backpine reserves the right, at its sole discretion, to discontinue hosting course materials or terminate access to content after 12 months from the date of purchase.

Such discontinuation may occur due to changes in business operations, technology platforms, or legal considerations. You acknowledge and accept that:

• Lifetime access refers to the operational lifetime of the platform and not to the user's natural lifetime.
• After 12 months, Backpine LLC may cease to host or support the course content without any obligation to provide alternative access, refunds, or compensation.
• Where feasible, Backpine will attempt to notify users in advance of any material change to content availability, but such notice is not guaranteed.
